Plagiarism Scandal for American Idol Daughtry, Beatles and Avril Lavigne

Bratty mall-punk Avril Lavigne and songwriting cohort Dr. Luke recently faced accusations that her hit song “Girlfriend” was largely stolen from the Rubinoos’ 1979 song, “I Wanna Be Your Boyfriend.” As the comparison here illustrates, the two songs are rather remarkably similar.

Lavigne denied that she had ever even heard the Rubinoos song, but the case was ultimately settled out of court, presumably for a considerable wad of cash.

Given the fact that Lavigne doesn’t exactly seem like a music expert (remember when she mispronounced David Bowie’s name while introducing the Grammy nominee in 2003? Read about it, here.), we believe she probably hadn’t heard the Rubinoos song. But, it seems likely that her songwriting partners had.

AOL reports that Dr. Luke is being investigated again, and this time he’s taking former American Idol contestant Chris Daughtry with him. In handy video clips, AOL compares Daughtry’s schmaltzy song, “Feels Like Tonight” with the Asphalt’s “Tonight.”

Once again, the verdict seems pretty obvious.

Regardless of whether these songs were actually plagiarized, the fact remains: they suck.

And, if these songs are not only awful, but also stolen, then that is truly pathetic.
It’s one thing to write a bad song—but to swipe one?

Of course, Daughtry and Lavigne aren’t the first music stars to be accused of unlawfully copying someone else’s music.

Over the years, numerous rap and hip-hop groups have faced charges for illegal use of samples, but at least those infringements are at little more obvious, and perhaps less malicious.

In 1976, Beatles guitarist George Harrison was charged with copyright infringement after allegedly taking the melody for his post-Beatles song “My Sweet Lord” from the Chiffons’ 1963 hit, “He’s So Fine.” The court rule against Harrison, despite his protestation that while he didn’t intentionally copy the song, he may have “subconsciously copied” the melody.

Whether or not Harrison was guilty, at least he had good taste.

McCartney Divorce costs $48mill, Spitzer Girl Nude photo brings $1mill

Love isn’t cheap, just ask Paul McCartney and Eliot Spitzer.

It has been a busy time for Sir Paul McCartney.

With the recent announcement of a long-awaited deal with iTunes that will finally allow fans to buy downloads of their favorite Fab Five music, McCartney struck a digital goldmine.

Which brings us to Heather Mills McCartney.

Viewed by many as a gold-digger, Sir Paul’s ex-wife has been embroiled in a lengthy battle with the Beatle over his vast fortune. Today a judge ruled that McCartney’s ex, the mother of his daughter Beatrice, is entitled to $48.6million.

Considering they were only married for about four years (they wed in 2002 and McCartney filed for divorce in 2006), that comes out to just over $12million per year, or a little over one million dollars a month.

Another gold-digger making headlines, Eliot Spitzer’s prostitute friend Kristen, aka Ashley Alexandra Dupre, is turning negative publicity into slightly smaller payday, with sales of her mp3 music downloads jumping in price from $0.20 to $0.98 each, AP reported.

That’s not too shabby considering the songs are practically worse than the similarly skanky Pussycat Dolls.

Of course, Dupre was reported offered one million dollars to pose nude for Larry Flynt’s infamous Hustler Magazine.

We’ve heard musicians complain that losing their artistic dignity in the music industry makes them feel like whores, but some people take things too literally.

 

New details have surfaced surrounding Client 9/ex-New York Governor Eliot Spitzer’s, um, lady friend. The pricey prostitute has revealed that what she really wants to do is sing.

 

Maybe she should audition for American Idol. The judges didn’t seem to have a problem with recently booted male stripper David Hernandez.

Top American Idol Scandals

Another American Idol contestant is about to be bombarded by negative publicity.

This time around it’s 24-year-old David Hernandez who has been accused of working as stripper in male-oriented strip clubs.

It remains to be seen whether or not this will cause him to be disqualified from the contest. American Idol seems to have a pretty unreliable screening process for contestants, and also has a history of not dealing with violations of the rules in a fair manner—such as when Frenchie Davis was disqualified after her image surfaced on an adult website, but Antonella Barba was allowed to compete after adult photos of her surfaced.

It seems likely that the producers’ decisions on such matters have less to do with what’s fair, and more to do with grabbing ratings.

We don’t remember Carrie Underwood, Kelly Clarkson or Chris Daughtry causing this much trouble, but so much controversy is bound to help the ratings of this already insanely popular show.

It is difficult to keep track of all of the controversy from naughty photos, failed careers and drugs, we’re taking a look at some of the most notable Idol scandals in recent memory.

Top American Idol Scandals:

American Idol Stripper
2008 American Idol finalist David Hernandez is the only contestant currently being accused of moonlighting as a stripper, but we wouldn’t be surprised to find out that some of the female contests had pasts as, um, dancers.

Naughty American Idol Photos
Antonella Barba (season six), Frenchie Davis (season two) and this year, season seven finalist Ramiele Mulaby have all had racy (or downright filthy) photos surface on the internet. Unfortunately for them, neither their photos, nor their singing, were very memorable. Ouch!

American Idol Adult Videos
Jessica Sierra—Following a landslide of legal and personal problems stemming from drug use, Sierra was hit with another blow when a company announced plans to release an adult movie starring the season four Idol wannabe, TMZ reports.

Olivia Mojica—This season two contestant released a video so filthy, it even horrified sleazy celeb gossip show/webite TMZ.

Controversial Pasts of Idol Contestants
Carly Smithson—This Irish singer not only appeared on Idol in the past, she also had a failed career as a big time popstar—a fact that has enraged bloggers who believe Idol is supposed to discover unknown talent, not waste more time/money promoting failed acts.

Robbie Carrico—Another has-been getting a second shot on Idol, Carrico was eliminated last week, but not before enduring harsh criticism over his musical and stylistic makeover. The former boy band singer was a member of Boyz N Girlz United, dated Britney Spears and has been accused of wearing a wig or hair weave. You decide, photos here.

Danny Noriega—Seems like a sweet young singer, but this season seven finalist posted a bratty video on his myspace page cursing and ranting against Christmas while embracing emo eyeliner. Nice.

American Idol Legal Trouble
This is just a small sample of the legal troubles faces many past contestants of American Idol.

Mario Vazquez—Accused of sexually harassing an Idol employee during his time there during season four.

Jessica Sierra—Yup, she made the naughty list twice. This time it’s for battery charges stemming from a cocaine-related arrest in Florida.

Amanda Overmyer—Another season seven finalist, this nurse was recently arrested for driving while intoxicated. So far, no charges have been filed over her awful Cruella DeVil black/white hairdo (see it here).

Winehouse Not the Only Musician Banned in America

With the recent controversy surrounding what appears to be a video of Amy Winehouse smoking crack, it seems that things just keep getting worse for the troubled singer.

Although the singer has been nominated for several awards for her album Back to Black and the hit single, “Rehab”, it was recently announced that the US government has banned Winehouse from entering the country due to her criminal record.

Of course, Winehouse isn’t the first musician to be banned from the land of the free.

Music Banned in America

The Kinks
As their career was exploding in the 1960s thanks to hit songs like “You Really Got Me,” the Kinks hit something of a brick wall after being banned from the United States for four years following their 1965 tour, likely due to their wild behavior–onstage and off. Regardless of this sizable hurdle, group’s career endured, and the Kinks’ influence remains strong. However, the band never tapped into the mainstream the way contemporaries like the Beatles and Rolling Stones did.

Sex Pistols

It took quite a bit of persuasion, but the members of controversial punk band behind “Anarchy in the U.K” were eventually issued visas and permitted to enter the US to tour in 1978. The delay was due to US authorities’ concern over the group’s rowdy reputation and criminal records. The band may have been better off staying home. After less than a month of touring, bassist Sid Vicious fell deeper into heroin addiction and numerous violent brawls, and singer Johnny Rotten quit the band during a show in California. The band broke up and shortly thereafter Vicious stood accused of murdering his girlfriend before eventually overdosing in 1979. Vicious’ turbulent life is famously chronicled in the (fictionalized) film, “Sid and Nancy.”

And…

In addition to the instances where performers have been barred or delayed from entering the US, music censorship is common on American television and radio.Websites such as Free Muse do a nice job of chronicling the patterns of censorship in America, including the common practice of cutting or altering offensive lyrics in radio broadcasts (even Avril Lavigne’s bubblegum pop song “Girlfriend” has had lyrics cut).

MTV
Although it positions itself as the home of “reality” TV and coolness, MTV is no stranger to censorship. Recently, Sean Kingston’s popular song “Beautiful Girls” video had the word “suicidal” cut by MTV. Many other songs have faces similar fates, although the station doesn’t have an official list of banned words or phrases.

And does anyone remember the list of “lyrically inappropriate” songs that over a thousand Clear Channel radio stations allegedly temporarily banned in the wake of 9/11? Among the list of 160 songs recommended for the black list were Buddy Holly & the Crickets “That’ll Be the Day,” Van Halen “Jump,” Beastie Boys “Sabotage” and Frank Sinatra “New York, New York.” (view the complete list here)

While ideas of censorship are always ugly, in Winehouse’s case, it seems as though staying home and attending rehab should be much more important to performing “Rehab” on the Grammys.

Britney Spears is Dead…sort of.

The sweet young Britney Spears you used to love is dead.

With her ongoing erratic behavior, suspected drug use, custody battle and recent hospitalization, former Mickey Mouse Club star Spears has effectively committed suicide in her career as a popstar, but that doesn’t mean her career is over. Nothing attracts interest like controversy, and Spears is the queen at the moment.

If she can take a cue from some of these other notable musical trouble-makers, she just might be able to reinvent herself and come out on top of the music world once more.

So, who was raising hell before Britney came along?

It was only a few short years ago that the media’s favorite bleach-blonde disaster was Courtney Love. Conspiracy theorists are quick to claim that Love was involved in the death of husband/Nirvana bandleader Kurt Cobain, while music snobs insist that Cobain wrote the songs for Love’s band, Hole, on its breakthrough album, Live Through This.

Giving Britney some competition for the Bad Mother award, rumors persist that Love was using heroin during her pregnancy with her daughter, Francis Bean. Regardless of the negative publicity, Love got a clean-cut makeover and continued her music career as well as a surprisingly successful acting career, including a critically acclaimed role in The People vs Larry Flint. She hasn’t been doing so well lately, but odds are she’ll be back.

Controversy always follows pop queen Madonna. Unfortunately, most of her naughty behavior seems as contrived and calculated as her fake British accent (um, she’s from Michigan). Still, with her controversial sex book and pseudo-blasphemous “Like a Prayer” video, she’s managed to parlay her headline-making antics into an inexplicably enduring pop music career. Of course, the same cannot be said of her infamously awful acting turns.

Then again, maybe they’re even since Britney starred in her own awful karaoke-filled teen girl buddy flick, Crossroads.

Rock’n’roll’s original bad boys, the Rolling Stones have been stirring up trouble ever since they first hit the airwaves with suggestive numbers like, “Let’s Spend the Night Together.” Of course, the ensuing decades of sex, drugs and, occasionally, rock’n’roll have made them legends. And while band has seen some hard times (including the mysterious, possibly drug-influenced, death of guitarist Brian Jones in 1969), they’ve ultimately managed to cling to the top of the rock’n’roll mountain.

Coincidentally, in 2000 Brit recorded a version of the Stones’ classic “(I Can’t Get No) Satisfaction,” but due to her then-pristine image, she traded the original lyric “He can’t be a man, because he doesn’t smoke the same cigarettes as me,” for the more positive, “she can’t tell me who to be, because I’ve got my own identity.”

Nice try, Brit.

Of course, these are only a few examples of singers, musicians and other performers who have fallen on hard times. Many of them have managed to recover their careers, so maybe there’s hope for our trainwreck after all. Heck, for many bluesman and rappers, the hardest times provide the best musical fodder.

Her image as a cutesy popstar is dead. But, if Spears cleans herself up and waits a few months, then comes out with some sort of mature album/song triumphantly declaring that’s she’s been through hard times but now she’s back, she just might be bigger than ever.

Because, the only thing tabloids and consumers love more than watching a celebrity hit rock bottom, is watching them claw their way back up to the top.

10. Jessica Simpson—So, she was nice this year because she didn’t unleash any more terrible music on the world. Unfortunately, legions of angry Dallas Cowboys football fans think she’s a bad girl for causing boyfriend Tony Romo to botch the big game. Not sure we agree, but you know what they say: Don’t mess with Texas.

9. Hannah MontanaMembers of the sugar-pop singer’s fan club sued the Disney star because joining her fan club (and paying a fee) was supposed to make it easier for them to get tickets to her concerts, but it didn’t.

8. Austin Winkler (Hinder)—Known for his rock band Hinder’s (awful) hit songs such as “Lips of an Angel,” Hinder frontman Austin Winkler was arrested on suspicion of drunk driving on his way home from his engagement party. Our apologies to the lucky bride-to-be.

7. Rapper T.I.Arrested on charges of allegedly attempting to purchase a machine gun in October, just hours before he was scheduled to perform at the BET Hip Hop awards.
 
6. Rapper Remy Ma—Sometimes a collaborator of Terror Squad, Busta Rhymes and Eminem, this female rapper was arrested on charges in connection with a shooting. The alleged victim, Makeda Barnes-Joseph, is currently suing Ma for $20 million in damages.

5. Weiland—Formerly the front man for ‘90s alt-rockers Stone Temple Pilots, Scott Weiland’s inability to get a travel visa due to past issues with drugs caused his band Velvet Revolver to cancel it’s Japanese tour. He was also arrested after car accident in November and is suspected to have been driving under the influence.

4. Kid Rock—Nobody’s classier than Kid Rock. Pamela Anderson’s ex-husband apparently took a swing at her other ex, Tommy Lee, at a music awards show. In October, Rock got into a fight in the parking lot of a Waffle House in Atlanta. C-L-A-S-S-Y.

3. Pete Doherty—Possibly the world’s most famous junkie, and grossly skinny model Kate Moss’s on/off boy toy. Moss is currently (unsuccessfully) trying to block Pete from releasing a video of her allegedly snorting cocaine. Doherty has been in and out of rehab more times than I care to count. Apparently he sometimes makes music with his band, Babyshambles, not that anyone cares anymore.

2. Amy Winehouse—Recently photographed walking the streets of London in the middle of the night, confused and topless, Winehouse has also been arrested in connection with her husband’s legal issues (namely, allegedly beating up a bartender and allegedly attempting to interfere with his court testimony)

1. Britney Spears—What hasn’t Brit done this year? From shaving her head and driving without a license to hitting rehab and bombing at the VMAs, this former Mouseketeer has had a busy year.
